To commence 19 April 2010, the Minister for Immigration and Citizenship has issued:
- Select Legislative Instrument 2010 N0. 70, to amend Migration Regulations 1994 to improve the integrity of the business skills visa program;
- Select Legislative Instrument 2010 No. 71, to amend Migration Regulations 1994 to rectify an administrative error which resulted in the removal of certain criteria in some student visa subclasses.
Select Legislative Instrument 2010 N0. 70:
- Removes the ‘senior manager' eligibility for the Subclass 163 (State/Territory Sponsored Business Owner (Provisional));
- Specifies different values of business ownership (size of business, type of company) for certain business skills visa applicants;
- Increases the amount of the net value of assets required for certain business skills visa applicants.
Select Legislative Instrument 2010 N0. 71:
- Reinstates certain time of decision criteria, including access to funds, for:
- Subclass 571 (Schools Sector);
- Subclass 572 (Vocational Education and Training Sector);
- Subclass 573 (Higher Education Sector);
- Subclass 574 (Postgraduate Research Sector).
- Maintains existing highest assessment level criteria for Subclasses 571, 571, 573 and 574.
